Paghihintay sa ruling ng Court of Appeals,  para lutasin ang dilema sa Beneco

BAGUIO CITY – Sa ginanap na press conference noong Setyembre 13, 2021 sa Gen. Pedro Dumol Hall, Beneco, South Drive ay tinalakay ang ilan isyu na kung saan ay ang pagbasura ng korte ang petisyon laban sa pag-upo ni Atty. Ana Maria P. Rafael bilang NEA-Appointed General Manager ng Beneco matapos inihain ni GM Engr. Melchor S. Licoben ang petition for Certiorari, Prohibition and Injunction sa Court of Appeals.

Naunang ipinaliwanag ni retired Judge Adolf Malengdan, kaugnay sa siyam na pahina na order ni Judge Rufus Gayo Malecdan Jr. ng Regional Trial Court Branch 60, Baguio City,  ang rule on petition na inihain ng ilang members ng Beneco Employees Labor Union (BELU) at ng Beneco Supervisors Association (BSA) na kung saan ang petisyon ay denied by the court.

“The court has really jurisdiction over a petition in the first place it is the Court of Appeals that has jurisdiction over orders ruling or decision rendered by the NEA,”

Nakasaad sa Order ng RTC Branch 60, “This court’s lack of jurisdiction to issue a temporary restraining order or injunction against the implementation of any order, ruling or decision of the NEA is acknowledged by defendant ENGR. LICOBEN. Defendant Engr Licoben is cognizant of the lack of power of this court to grant the temporary restraining order. This is apparent in his POSITION PAPER as well as the admitted fact that he filed a Petition for Certiorari, Prohibition and Injunction before the Hon. Court of Appeals seeking to enjoin the assumption of defendant ATTY RAFAEL-BANAAG as General Manager of BENECO based on NEA-BOA resolution No. 2021-47”

Sinabi ni Malengdan, “They have to respect the authority of the higher courts and definitely the issue here will be finally resolve once the Court of Appeals will rule, antayin natin yun ruling ng Court of Appeals, huwag natin pangunahan, kasi mahirap naman, ang mas mababa na korte kung wala silang jurisdiction sa isang kaso and then make a ruling, sila naman yun matatamaan ng gross ignorance of the law,”

Samantala, Hindi pa gaano makapag-umpisa ng trabaho si NEA Appointed GM Rafael hanggang hindi maayos ang kanyang pagpapaandar sa kanyang mga nasasakupan departamento lalo na’t naging mistulang iskwater ang kanyang opisina sa Dumol Hall, na ilang araw walang kuryente.
