City to mandate registration of ambulant vendors

The City Council, during last Monday’s regular session, approved on first reading, a proposed ordinance providing for the registration of ambulant vendors, roving vendors or peddlers, street vendors and market vendors without  stalls and establishing the policies and guidelines on the operation of vendors in the city and for other purposes.

Under the proposed ordinance, all street vendors, ambulant vendors or peddlers and market vendors without stalls shall register with the Baguio City Market Authority (BCMA).

Subsequently, the BCMA technical working group (TWG) shall screen and recommend qualified vendors to do business in the city.

The BCMA TWG shall be chaired by the Chairperson of the City Council Committee on Market, Trade, Commerce and Agriculture and the head of the Public Order and Safety Division, president of the Liga ng Mga Barangay, City Environment and Parks Management Officer and Market Superintendent as members.

Market vendors without stalls, street vendors, ambulant vendors, peddlers or roving vendors shall, prior to their registration, present their voter’s certification indicating that the vendor is a registered voter of the city; barangay certification indicating that the vendor is a resident of the barangay where he or she vends or proposes to vend; provided, however, that the vendor has actually resided in the barangay for at least six months prior to registration; BCMA certification that the vendor is not a registered lessee of any stall; medical clearance or doctor’s clearance stating that the vendor is fit to sell and certification issued by the Chairperson of the BCMA-TWG certifying that the vendor has substantially complied with the documentary requirements for registration.

A duly registered vendor shall have preference in the selection of applicants for permanent or temporary stalls in the public market and satellite markets; preference in the selection of occupants of temporary stalls or areas available for vending within or outside the central business district; preference in the selection of beneficiaries of other grants, services and benefits enjoyed by regular lessees of stalls; and right to organize for a better representation in management.

Ambulant or roving vendors are allowed to sell goods such as dairy products; peanut products; fruits and vegetables; belt and other leather products; sun glasses; silver jewelries; dried fish products; native cakes, pastries and other bakery products; hot and cold drinks; non-alcoholic beverages; ice cream products; cooked meals; soya bean products such as taho and tokwa; pork cracklings or chicharron; and boiled eggs, among others.

However, they are not allowed to sell tobacco products, alcoholic beverages as well as items not listed previously.

No unregistered street vendor, ambulant vendor, or peddler, market vendor shall be allowed to vend in the authorized vending areas or barangays.

On the other hand, street vendors, ambulant vendors or peddlers, roving vendors and market vendors without stalls shall not be allowed to vend in frontage, rear and sides of private and public buildings; parks and playgrounds, alleys, roads and streets within the central business district; Burnham Park reservation area and any space in the barangays in the central business district.
